Xindi Yunhui violated the first-hand sales case, a fine of 50,000

Sun Hung Kai Properties launched its new prefecture in Sham Shui Po, Tai Po, Tai Po, which was suspected to be in breach of the First-hand Residential Property Sales Ordinance

It did not specify in the register of transactions that the prepaid amount of property paid in advance was refunded. The first-hand residential property sales supervision bureau (the Bureau of Sales and Supervision) sued for failing to stipulate the terms in the transaction register. The developer company pleaded guilty to the charge in Kwun Tong Court yesterday and was fined $50,000.

Lawyer: Unintentionally concealing important information

The case stated that the defendant, Ruiyu Co., Ltd., launched the first phase of Yunhui in June last year. The bidding documents stipulated that if the buyer paid the property price in advance, he would receive a cash rebate of three to six percent. However, in March this year, the Administration found that the “transaction register” provided by the defendant company only listed the name “pay cash rebate in advance”, but the above percentage was not listed.

The defense lawyer pleaded that this is the first time that a developer has been prosecuted for violating this crime

The information that the defendant company was accused of missing is in fact not listed in the industry. Since the incident, the SFC has issued further guidance on the requirements for listing the information. It shows that the Administration agrees with the trade or misunderstood the law. The lawyer stressed that the defendant did not deliberately conceal important information. He only made some omissions. The company recognized the responsibility and immediately made remedial measures to put all the information required to be disclosed in the legislation for public inspection.
